Hawaii generally uses a no-fault system for injuries arising from motor-vehicle accidents. Personal injury protection benefits can provide coverage without requiring an initial determination of fault, although Hawaii law limits when an injured person can pursue tort damages against another party.
This no-fault framework is designed to provide certain benefits for accidental harm while generally restricting tort claims unless specified circumstances exist.
Hawaii law provides exceptions to the general abolition of tort liability for certain serious circumstances. These include death, a significant permanent loss of use of a body part or function, permanent and serious disfigurement that causes mental or emotional suffering, or cases in which the applicable personal injury protection expenses reach the statutory threshold.
