What Compensation Can Injured Drivers Recover After a Crash in Keaau, HI?

People injured in a Hawaii collision may first receive compensation through personal injury protection, or PIP, regardless of who caused the crash. Hawaii’s no-fault system can provide benefits for reasonable and necessary medical expenses, rehabilitation, and certain income losses resulting from an injury. These benefits are generally available without first proving that another driver was negligent.

The amount and type of recovery can depend on the person’s injuries and the applicable insurance coverage. Medical treatment, hospital care, physical therapy, and rehabilitation can create significant expenses after a two-vehicle collision.

PIP benefits may help address qualifying medical costs and certain wage losses, although Hawaii law places statutory limits on these benefits. Keeping medical bills, treatment records, and documentation of missed work can help establish the losses associated with the injury.

Additional compensation may become possible when an injury satisfies one of Hawaii’s statutory exceptions to the state’s no-fault restrictions. Those exceptions include death, significant permanent loss of use of a body part or function, permanent and serious disfigurement that causes mental or emotional suffering, and qualifying medical expenses that reach the statutory threshold.

When an exception applies, an injured person may be able to pursue damages beyond the benefits available through the no-fault system, including compensation for pain and suffering. A Keaau car accident lawyer can evaluate the injuries and available documentation to determine whether these requirements may be met.
