What Happens When a Fatal Crash Leads to Criminal Charges in Pāhoa, HI?

When a fatal traffic crash results in criminal charges, there may be both criminal and civil proceedings arising from the same set of facts. Criminal charges focus on whether a law was violated and what penalties may apply, while a civil claim generally focuses on the losses suffered by surviving family members and whether compensation may be available.

A criminal case does not automatically determine the outcome of a civil claim. Different legal standards apply, and evidence gathered during an investigation may become relevant in both matters. Families coping with the loss of a loved one may have questions about insurance coverage, available benefits, and the deadlines that apply to wrongful death actions under Hawaii law.

Beyond the emotional toll of a fatal collision, families often face funeral expenses, loss of financial support, and other unexpected burdens. A wrongful death attorney can explain how a wrongful death claim works, review available information, and discuss what legal options may exist based on the circumstances.
