What Should E-Bike Riders Know About Comparative Fault in Honolulu, HI?
Hawaiʻi uses a comparative negligence system for personal injury claims. This means that even if you were partly at fault for the accident, you can still recover damages as long as your share of the blame isn’t greater than the combined fault of the other parties. However, whatever amount you’re awarded will be reduced based on your percentage of fault.
That rule can matter when an e-bike rider and a motor vehicle are involved in the same collision. Questions about traffic movements, visibility, roadway conditions, and each person’s actions may affect how fault is evaluated.
Medical documentation can be particularly relevant when an e-bike rider has suffered an injury. Records from an ambulance trip, emergency evaluation, follow-up appointments, imaging, and other treatment can help establish what injuries resulted from the collision and what care may be necessary.
A personal injury lawyer in Honolulu can review those records alongside witness accounts, photographs, and other available evidence when assessing how comparative negligence could affect a potential claim.
