Compensation That Victims Can Recover After a Motorcycle Accident in Hawaii

Motorcycle accident victims in Hawaii may be eligible to seek several types of compensation depending on the circumstances of the crash. These generally fall into two categories: economic damages, which cover measurable financial losses, and non-economic damages, which address the broader personal impact of the injuries. Understanding what may be available helps victims and their families make informed decisions about next steps.

Economic damages typically include medical expenses such as emergency treatment, hospital stays, surgeries, rehabilitation, and ongoing care. Lost wages are also recoverable when injuries prevent a person from returning to work. In more serious cases, where long-term disability affects a person’s ability to earn income in the future, compensation for loss of earning capacity may also apply.

Non-economic damages cover the physical pain, emotional distress, and reduced quality of life that often follow a serious motorcycle crash. These losses are harder to calculate but are recognized under Hawaii law as legitimate grounds for compensation. Courts and insurance adjusters consider factors such as injury severity, recovery time, and the impact on daily activities when evaluating these claims.

Hawaii follows a modified comparative negligence rule. This means a victim can still recover compensation as long as they are found to be 50 percent or less at fault for the accident. However, any compensation awarded is reduced by the percentage of fault assigned to the injured party. This makes it important to gather strong evidence early, including photos, witness accounts, and medical records.

Motorcycle crashes often involve complex insurance negotiations, especially when injuries are severe or liability is disputed. A motorcycle accident attorney can review the available evidence, communicate with insurance companies, and explain what compensation options may realistically apply to a given situation.
