Wrongful Death Claims in Hawaii
Anytime a person’s dereliction, misconduct, or negligence results in someone’s death, their surviving family members are entitled to bring a claim of wrongful death against the at-fault party.
Depending on the events surrounding the fatal incident, recovery might be available for damages including:
- Funeral costs/Burial or cremation expenses
- Medical bills amassed prior to death
- Lost income and financial assistance
- Loss of services and support for the household
- Loss of consortium
- Loss of love and guidance
A wrongful death action is a civil claim. This means it will be overseen in a civil court and will be completely separate from any corresponding criminal case that may involve the defendant. Just like other civil injury claims, those filing the suit will be required to show that the respondent is responsible or otherwise accountable for the death due to their negligence.
As a civil claim, the primary goal of a wrongful death suit is adjudicating whether the respondent is liable for the damages endured by the deceased and their surviving family.
