Waialua, HI – Two Dead After Aircraft Crashes at Kaena Point
November 7, 2022
Waialua, HI (November 07, 2022) – An aircraft owned by Paradise Air went down on the morning of Saturday, November 5th at Kaena Point State Park on Oahu’s North Shore, resulting in the deaths of both the pilot and his teenage passenger.
The fatal incident shut down the road leading to Kaena Point for several hours.
Honolulu Emergency Medical Services and other rescue services responded to the crash in the area of Dillingham Airfield at about 8:15 a.m. The two men, one thought to be in his 50s or 60s and a teenager died at the scene. Their identities have not been released.
The co-owner of Paradise Air Hawaii Inc., Denise Sanders, stated the pilot and the motorized hang glider involved in the wreck were contracted by the company. She declined to identify the pilot but confirmed he was the elder of the two victims.
According to the Federal Aviation Administration, a two-seat ultralight trike, a single-engine EDGE XT-912-L, went down under circumstances not yet known with two people on board.
The National Transportation Safety Board and the Federal Aviation Administration are leading the investigation. Several drivers, mostly people hoping to explore Kaena Point and Oahu’s North Shore, were turned away at Kaena Point
One local observed that the winds were very rough for the type of light aircraft involved in the incident.
We would like to offer our deepest condolences to the families of the deceased victims at this time.
Wrongful Death Suits in Hawaii
Since it is a civil claim rather than a criminal one, the central purpose of a wrongful death action is to judge whether or not the respondent is liable for the losses endured by the victim and the surviving members of their family. Just as with any civil injury case, families who wish to bring a wrongful death lawsuit will be required to show that the respondent caused or facilitated the death through their negligence or is otherwise answerable based on the state’s liability laws.
For example, a person might be found responsible for wrongful death if:
- Their negligence or recklessness, such as driving drunk, led to the victim’s death
- They were a nurse, doctor, or another medical provider who perpetrated medical malpractice by failing to meet the medical standard of care during the victim’s diagnosis or treatment
- They were a retailer, distributor, manufacturer, designer, or other commercial entity responsible for a faulty or dangerous product on the market
- They were the owner or manager of a property with an unacknowledged, unrepaired hazard that caused the death of an invitee or licensee
- Purposefully and knowing committed murder or egregious physical assault
