Wrongful Death Suits in Hawaii

Puna, HI - One Dead Following Vehicle Crash on Kahakai Blvd

When someone’s negligence, malfeasance, action, or inaction causes the death of another, certain surviving relatives are eligible to file a wrongful death claim against the at-fault party.

While we understand that there is no amount of money that can bring back your loved one, a well-constructed wrongful death claim can give grieving relatives a measure of justice as well as the financial compensation they are entitled to for their losses.

Based on the events surrounding the death, compensation could be available for multiple damages such as:

  • Cremation expenses/Burial and funeral costs
  • Medical expenses incurred prior to the death
  • Loss of family and household services
  • Lost economic aid and lost earning
  • Loss of care and guidance
  • Loss of companionship and consortium

A wrongful death action is a civil claim, meaning they are addressed in a civil court and are differentiated from any and all criminal cases involving the respondent.

Due to being a civil claim, wrongful death actions center on adjudicating whether the respondent is answerable for the losses endured by the victim and their surviving family. Comparable to other types of civil injury cases, those who bring a claim of wrongful death will be required to show that the respondent is liable for their loved one’s passing via negligence or, in accordance with liability laws, is otherwise liable.
