Pedestrian Accidents in Hawaii

Pearl City, HI - Lanes Closed Following Pedestrian Accident Near Waimano Home Rd

As with many pedestrian accidents, the fault lies with both the driver and the pedestrian. While this does not mean that the pedestrian is ineligible to collect any financial compensation, it could mean that their compensation is decreased by a percentage proportional to their degree of fault for the accident.

Pedestrian behaviors that typically cause them to share liability for their injuries include:

  • Crossing on the “don’t walk” signal
  • Crossing where no crosswalk is present
  • Jumping in front of traffic
  • Running into the roadway without looking

Speeding or drunk drivers who hit pedestrians crossing the street in an unlawful manner, such as outside of the crosswalk, might still be liable for a percentage of the damages.

At Leavitt, Yamane & Soldner, we are focused on the full recovery of our clients in the fastest and most comfortable way possible. After being injured in a pedestrian accident, victims have a very limited window of time in which to bring a personal injury claim. Pedestrian injuries usually involve a lot of medical bills, pain, and suffering and often result in fatalities that allow certain surviving family members to pursue compensation via a wrongful death claim.
