Maui, HI (October 17, 2024) – Local officers are investigating following a car crash that occurred in the Lahaina area on Thursday morning, October 17.
According to reports provided by the Maui Police Department, a collision between two vehicles took place in the area of the Lahaina Bypass and Lahainaluna Road in Lahaina. The incident prompted authorities to close down the roadway after vehicles were blocking most lanes in the area before calling in EMTs to assess the victims’ injuries.
Emergency medical services responded to care for victims who were injured as a result of the crash, and those who required further medical attention were transported to local hospitals. At this time, however, the incident is still being investigated, and it’s unclear how many people were ultimately hurt in the incident. Witnesses were asked to get in touch with the MPD.
Our thoughts go out to the injured victims and their families at this time.
Injury-Causing Crashes in Maui
A personal injury suit allows victims to claim economic damages, such as medical costs and lost income, as well as non-economic damages, like pain and suffering. That said, the statute of limitations on personal injury claims in Hawaii is two years from the day of your accident. Most insurance carriers, however, will not wait that long for you to make your claim. Car insurance policies typically contain provisions for making your claim promptly, which generally means within a few days.
Proving these kinds of cases demands an experienced and knowledgeable car accident lawyer in Maui who understands Hawaii’s car insurance laws to find other sources of reimbursement, like uninsured motorist coverage in cases involving a driver with no insurance or underinsurance motorist coverage in cases involving drivers with inadequate coverage.
Like other no-fault insurance states, Hawaii also sets a tort threshold for suing the negligent driver in a traffic accident. In Hawaii, you may only file a personal injury suit if:
- You suffered medical expenses and other related damages totaling $5,000 or more
- You sustained severe or permanent injuries like the loss of a bodily function, loss of a body part, or disfigurement
Considering that Hawaii does not impose any valuation restrictions on the filing of a lawsuit for property damage, this threshold applies to claims for personal injury. Property cases are still subject to the two-year statute of limitations, and insurance claims are subject to the same restrictions about timely reporting throughout the whole process.
