Passenger Injuries in Hawaii

Kapolei, HI - Single-Vehicle Rollover on Kamaaha Lp Leaves Three in Serious Condition

Hawaii tourists, visitors, and residents often sustain serious injuries as a passenger in car accidents due to reckless or negligent drivers. Passengers injured in motor vehicle accidents are just as entitled to compensation via a Hawaii personal injury case as an injured driver.

Under Hawaii law, a passenger is eligible for financial compensation even if they were in the car with the at-fault driver. Along with recovering from the negligent driver’s insurance company, passengers might also be entitled to collect via an uninsured/underinsured driver policy. This is why it is essential for passengers to determine all insurance policies of everyone in an accident.

In Hawaii, passengers do not need a driver’s consent to file a personal injury claim. Where passenger injuries are concerned, it is vital to never depend on a driver for advice or information. While most drivers would not deliberately mislead an injured passenger, their lack of knowledge about the state’s personal injury laws can have negative consequences on the victim’s ability to collect compensation.

If the injured passenger fails to file with the liable driver’s insurance carrier, they will forego thousands of dollars in recovery for medical bills, wage loss, pain and suffering, and any and all other damages.
