Hawaii Traffic Accidents
When an individual’s negligence, wrongdoing, action, or inaction leads to the death of another person, the surviving relatives of the decedent will most likely qualify for financial compensation when they file a wrongful death claim against the responsible party.
A wrongful death lawsuit is defined as a civil claim. This means it will be handled in civil court, separate from any criminal case involving the defendant. Wrongful death claims focus on deciding whether or not the defendant is responsible for the losses suffered by the victim and their family members.
Family members who file wrongful death suits must prove that the defendant caused the death of their loved one by acting negligently or is otherwise responsible according to liability laws.
For example, an individual may be found liable for wrongful death if:
- Their negligence resulted in the death of the victim, is in a fatal auto accident
- They were a nurse, doctor, or other health care professional who engaged in medical malpractice by failing to meet the necessary standard of care during treatment
- They were a manufacturer, distributor, designer, retailer, or other commercial entity responsible for a defective or dangerous product
- They were the owner of a property that housed a danger that was unaddressed and led to the death of a guest
Even though no amount of financial compensation is able to turn back time, a successful wrongful death claim will offer surviving family members justice and financial compensation for damages.
Depending on the circumstances of a fatal accident, financial compensation is available for:
- Funeral care/burial costs/cremation
- Medical care costs
- Lost income/lost financial aid
- Loss of consortium/companionship
- Loss of household service/childcare
- Loss of guidance/advice/care
