Hawaii Pedestrian Accidents
A collision between a pedestrian and a motor vehicle typically results in catastrophic injuries, significant medical costs, and considerable pain and suffering. In Hawaii, any pedestrian struck by the driver of a vehicle might be eligible for a financial settlement intended to compensate them for the same losses that are available to the occupant of a vehicle involved in a car accident.
The severe nature and degree of pedestrian injuries are often fatal. Even at slower speeds, the size and speed of a vehicle compared with that of a pedestrian can result in debilitating and life-threatening injuries. Some injuries that Hawaii pedestrian accident victims often sustain include:
- Brain injuries/Head injuries
- Injuries to the spinal cord
- Fractured bones/Broken bones
- Torn ligaments and tendons
- Soft tissue injures/Disc herniation
If you intend to pursue financial compensation following a Honolulu pedestrian accident, you will have to show that the driver of the striking vehicle caused your accident through negligence. To prove negligence in a personal injury case, there are four elements that must be proven: duty, breach of duty, causation, and damages.
Drivers have a responsibility to obey the rules of the road. This means that their duty to pedestrians is easy to establish. Proving the driver breached that duty will require a detailed review of the facts of the accident.
One common problem with these kinds of accidents is that pedestrians are hit without warning. Due to this, essential facts are often unknown to the victim and an accident reconstruction expert may have to be consulted.
Causation between your injuries and your accident also has to be proven. If the victim had pre-existing injuries in the same area of their body affected by the accident, causation could become a problem very early on. Lastly, damages will have to be established through victim testimony combined with the testimony of a medical expert.
Proving a Honolulu pedestrian injury case can be difficult. Insurance carriers use sophisticated strategies and underhanded tactics to avoid paying victims the financial compensation they are entitled to.
