Motorcycle Accident Fatalities in Hawaii
Following a serious motorcycle accident, victims or their surviving family members must deal with the adversarial process of communicating with the at-fault driver’s insurance carrier. The insurance provider is under no obligation to provide benefits to or negotiate in good faith with an injured accident victim if they can categorically prove that their policyholder was not responsible for the accident.
The sooner an insurance adjuster can speak with the victim, the more evidence they can collect to use against them in future negotiations.
Often, the only way to obtain a fair settlement award for an injury or wrongful death is to file a suit and litigate the claim. Insurance companies also have a reputation for forcing cases to trial. A common tactic employed by insurers is to stall the legal process as long as possible hoping that the claimant or their family will eventually concede defeat.
At Leavitt, Yamane & Soldner, we routinely counteract these kinds of delay strategies through assertive litigation and the willingness to see your wrongful death case through trial.
