Honolulu, HI Drivers Should Know How Fault Can Affect an Injury Claim

Hawaii uses a comparative negligence system when determining damages in many injury claims. This means that a person’s own negligence does not automatically prevent recovery when that negligence is not greater than the negligence of the person or parties being sued. Any damages awarded can be reduced based on the percentage of fault attributed to the injured person.

This can become more complicated when several vehicles are involved. A claim may require an examination of each driver’s actions and how those actions contributed to the overall crash. Evidence such as photographs, vehicle damage, witness accounts, traffic-camera footage, and available reports can help establish what happened and how responsibility should be assigned.

Preserving this information can be especially useful when multiple drivers or insurance companies are involved. A Honolulu car accident lawyer can review the available evidence and insurance information to determine how Hawaii’s comparative negligence rules could apply.
