How Long Do Families Have to File a Wrongful Death Claim in Honolulu, HI?

Hawaii generally allows two years from the date of death to file a wrongful death claim. Certain circumstances may affect which filing rules apply.

When a claim involves a state or local government agency, different notice requirements or procedures may apply. These requirements can affect the steps a family must complete before pursuing the claim.

If a wrongful death claim is filed in Hawaii, the deceased person’s legal representative or eligible survivors may bring the action. Eligible family members can include a spouse or reciprocal beneficiary, children, parents, and people who depended on the person who died.

After a wrongful death, compensation may include lost financial support, funeral and burial expenses, and the loss of love, companionship, care, or guidance. The available damages depend on the family relationship and the losses resulting from the death.

Because some losses belong to the estate, a separate survival claim may address harm the person experienced before death. This may include medical expenses and other losses that arose before the person died.

Once compensation is awarded, the court determines how wrongful death damages are divided among eligible family members. The distribution may differ based on the losses each person experienced because of the death.

As the claim moves forward, a Honolulu wrongful death lawyer can explain how Hawaii’s filing period may apply to your family. An attorney can also handle communication with insurers and file the necessary paperwork before the deadline passes.
